Having become a sight-disabled person while working in housing and communal services, a woman began to fight for easier working conditions.

Regional judge Stanislau Trapuk compelled Hlubokae housing and communal service to reinstate Aksana Muskat in her job and pay her compensation of BYR8 million, Radio Racyja reports.

Aksana Muskat, employees of Hlubokae housing and communal service, was dismissed for absence without leave. Having become sight-disabled person while working there, she began to fight for the right to easier working conditions.

- I lost all hope; I thought it made no sense to be at law with public services. I am grateful to judge Trapuk for triumph of justice, Aksana Muskat says.

Stanislau Trapuk explains that there were much nonconformities in documents and elements of claim were not fully challenged.

-Decision upon her dismissal for absence without leave was made without a proper and detailed consideration of all the circumstances. In addition, the employer ignored Article 283 of the Labour Code, as well as the law on social protection stating that during the individual rehabilitation programme dismissal on the initiative of the employer is not possible, the judge added.

It should be recalled that the pre-trial stage resulted into nothing positive to Aksana Muskat. Then lawyer of the housing and communal service Aliaksandr Alekseenka did not agree to reinstate Aksana in her job. Therefore, the employee appealed to the court and won. The representative of the service presented at the hearing did not comment on it.
