Investigative Committee’s opinion: beating of graffiti artists was legal

Yaraslau Ulyanenkau, one of the detainees in the “graffiti artists’ case”, was denied to initiate proceeding against policemen for their actions.

In an answer signed by A. Varabey, the chief investigator of Frunzenski district department of Investigative Committee, it is said that an enquiry had been made regarding the fact of battery during detention. According to the results of this enquiry, it is denied to open a criminal case, due to the absence of elements of a crime in the actions, “Nasha Niva” writes.

“Notably, I visited doctors, and had my battery-induced injuries of ribs and legs verified. But that’s the answer I has been sent,” Yaraslau says. He plans to challenge this denial.

Besides, the accused and suspects in the “graffiti artists’ case” have lodged a complaint to the head of the Investigative Committee and to the General Prosecutor’s Office against the article posted on the website of the Investigative Committee, which has a title “Investigative Committee continues to investigate the criminal case involving hooliganism and damage to property in the capital.”

Maksim Pyakarski, Vadzim Zharomski, Vyachaslau Kasinerau and Yaraslau Ulyanenkau view the information on the website of the Investigative Committee as a direct violation of their presumption of innocence and the right of defence, and also as insult to their honour and dignity.

We remind that on August 11 five young men were detained and beaten up as suspects for making graffiti in Belarusian and painting over a social advertising billboard with policemen on it. On August 20 the Investigative Committee formally charged Maksim Pyakarski and Vadzim Zharomski under Part 2, Art. 339 of the Criminal Code, “hooliganism committed by a group of persons.” On August 31 the detainees were released on recognizance and after signing an agreement not to disclose materials of preliminary investigation.
