The leader of the REP Trade Union filed a complaint in connection with the violation of his right to freedom of expression.

Chairman of the Belarusian Independent Trade Union of Radio Electronic Industry Workers (REP) Henadz Fiadynich filed his personal complaint with the UN Human Rights Committee. There he points out to violating the International Covenant on Civil and Political Rights articles by Belarus, REP legal inspector for Homel region Leanid Sudalenka told BelaPAN.

Fiadynich informs that, according to the decision of the Tsentralny district court of Minsk of June 2, 2016, he was brought to administrative responsibility for violating the order of organizing and holding mass events – he was imposed a heavy fine of 6 million 300 thousand denominated rubles for the rally in Minsk in connection with the refusal of the Minsk City Executive Committee to provide premises for a trade union congress. His complaint in City Court remained without satisfaction, the District Court decision entered into force.

“The judicial authorities made no attempt to explain why the restrictions of the right to expression in this particular case might be necessary to achieve a legitimate objective within the meaning of Part 3 of Article 19 of the International Covenant on Civil and Political Rights. In the absence of any reasonable explanation, justifying the conclusions of the court, I consider that bringing me to the administrative responsibility for the expression of my personal opinion, using a peaceful assembly, was not necessary in the interests of national security, public order, protection of morality, health of the population, rights and freedoms of other people. Therefore, I conclude that in this particular case, my rights under articles 19 and 21 of the International Covenant on Civil and Political Rights have been violated,” – Henadz Fiadynich explains in his complaint.

The trade union activist points out, that the Universal Declaration of Human Rights proclaims the right of everyone to freedom of expression. And the International Covenant on Civil and Political Rights (Article 19 and 21) recognizes the right of everyone to freedom of information and of peaceful assembly.

The leader of the REP Trade Union asks the UN Human Rights Committee establish a violation of his rights by the Republic of Belarus and recommend to the Government to bring the rules of national law “On Mass Events in the Republic of Belarus” in accordance with international obligations, namely in accordance with Articles 19 and 21 of the International Covenant on Civil and Political Rights.

“It has always been important, and it’s especially important today to strive for restoring violated rights in each case of violating civil and political rights of citizens by officials of Belarus. And even if the government is ignoring the decisions of the Human Rights Committee, tomorrow it will not be able to do it any longer. All these decisions do not have a limitation period, and therefore will be necessarily executed, and, possibly, the current government, not a new one, will have to deal with them. I am sure all the victims of violations are bound to be rehabilitated and restored to their rights!” – Sudalenka commented.
