Relatives of Niamiha pedestrian subway throng victims (1999) raised a claim to the Moscow District Court of Minsk against the Minsk executive committee, city police department, Class-club “Jazz Craft”, brewery “Alivaryia” and radio station “Mir”.
Three years ago, on August 1999 the court withdrew legal proceedings. Public prosecutor’s office brought up a criminal action against two top police officers, Viktar Rusakevich and Uladzimer Kandratsin. They were charged with criminal negligence that had caused 53 deaths. This criminal action was withdrawn on March 25, 2002 according to the statute of limitations. Nobody was accused.
But parents want to continue civil suit and demand moral compensation equal to 100 mln BLR.
In their petition parents demand to examine all witnesses, including former Minsk Mayor and former Prime Minister Uladzimer Yarmoshin and some of Minsk executive committee officers and OMON officers.
The last hearing took place today. It was scheduled for 12 a.m. But the hearing started only at 2 p.m. Relatives and attorneys suffering from hot weather entered the courtroom. Judge Husakova announced the verdict: the court has not met the claim of the relatives of Niamiha victims. Parents are set to appeal a decision in the Minsk city court.
