BCD gets ultimate denial of registration

The Ministry of Justice of Belarus took a final decision to deny registration to the Belarusian Christian Democracy party.

A number of contradictions and conflicts with the Belarusian legislation were found in the BCD documents.

“A number of mutual contradictions and conflicts were found during examining the documents. To figure out the situation, the Ministry of Justice required the BCD party two times to file the documents relating to the party formation. However, BCD party representatives ignored the requests thus making the Ministry of Justice terminate registration of the party,” the ministry's conclusion says.

“The analysis of the documents revealed violations in the order of the BCD party creation and facts of submitting fake or invalid documents.

For example, the number of delegates elected for the BCD party founding meeting did not meet the representational quota established by the party initiators. Rights of all persons present at the founding meeting were not defined.

The above mentioned and other violations prove the illegitimacy of the founding meeting.

In spite of the request of the Ministry of Justice, the BCD party did not confirm the rights of the landlord to lease premises to the BCD party, thus the letter of guarantee relating to BCD's statutory seat cannot be recognized a legally valid document.

Some persons are mentioned twice in the list of BCD founders and their signatures do not match one another. The list of BCD founders also contains the names of the persons, who do not define themselves as party founders. Certain founders are citizens of the Russian Federation, so they cannot act as BCD party founders under the legislation of the Republic of Belarus.

The given facts prove the invalidity of both mentioned lists.

Besides, a number of provisions of the charter of the BCD party do not comply with the legislation of the Republic of Belarus.

In view of the given facts, in accordance with the Law of the Republic of Belarus on Political Parties, the Ministry of Justice took a decision on February 14, 2012, to deny registration to the BCD party,” the conclusion on the Ministry' of Justice's website reads.
