School Admitted That There Was Labor Relationship Between Collective Farm And Eighth-Grader

The school where the girl, who was killed while harvesting potatoes, studied, has changed its position in the court.

December 6, the principal of Maladzechna school № 11 Aliaksandr Liulkovich, speaking today in the court, actually admitted that there was an employment relationship between JSC "Voskhod-Agro" and the 13-year-old schoolgirl Viktoria Papchenia who was killed on the field during the potato harvest on September 29.

The activist of REP Trade Union Andrei Stryzhak, representing the interests of the dead girl's father Aleh Papchenia in court, said this to praca-by.info.

Today, the Maladzechna district court held another hearing of the case of the dead schoolgirl. Representatives of REP Trade Union assume, that the verdict on the recognition of existence of an employment relationship between Victoria Papchenia and JSC "Voskhod-Agro" will be announced in the near future.

The school has adjusted its position, – said Andrei Stryzhak. – Earlier, former deputy director for educational work Dzianis Kurets was the school’s representative in court. It was he who formed the group of students for gathering potatoes, took a decision to include the eighth-graders and gave the order for signature backdated. Today, the school has been represented by director Aliaksandr Liulkovich, who at the time of the tragedy was on vacation. He said during his speech that the school was not able to give a legal assessment, because they had no legal department. But at the same time, he noted that in accordance with the law labor relations begin with the actual moment of their start. In other words, a man takes a potato, puts it in a bucket, and this means that he works. In addition, referring to the law, he said that an employment contract cannot be signed by an employer and a person under the age of 14. The director concluded that the school acknowledged the fact of labor relations, but the final decision had to be taken by the court, – the trade unionist said.

It is to be recalled that the REP trade union renders every possible assistance to the dead girl’s parents to help them prove the fact of illegal labor relations, which became the cause of the tragedy.

As REP trade union legal inspector Leanid Sudalenka previously noted, "it’s difficult to estimate the life of your own child, but we have to claim the reimbursement, accrued to the family."

Andrei Stryzhak explained the trade union's position:

– Our legal department has been consistently advocating the contention of the fact of labor relations. And it is important not only for the deceased girl’s parents. Firstly, the legal precedent of recognizing labor relations between a minor child and an agricultural enterprise will create a situation, when a collective farm will think three times over before bringing in children to work in the field. Secondly, the Ministry of Education ban on using pupils (which was only formal and was violated by education departments), will work in full force, and our children will be insured from forced labor, – Andrei Stryzhak concluded.
