It turned out that the matter is out of the judges’ "competence".

The court of Tsentralny District of Homel rejected the claim of the president of the World Association of Belarusian Jews Yakau Hutman against the Homel City Executive Committee and the Mozyr District Executive Committee. Hutman asks to overturn the authorities' decision on building houses in the territory of former Jewish cemeteries.

"According to judge Volha Varonenka’s definition, I allegedly have no right to file such claims in court, since this case cannot be considered in courts at all due to the" lack of their jurisdiction." The decision has not yet entered into legal force, and at present I am considering the possibility of appealing against it. Belarus has undertaken international obligations to protect the sites of the former cemeteries of all national, religious and ethnic groups as a cultural heritage," – Yakau Hutman told Radio Svaboda.

The suit is to do with the construction of an 18-apartment building in Sozhauskaya street, 5 in Homel and a multi-storey house with a complex of household buildings in Pushkin Street, 14, 14a, 14b in Mozyr. Jewish cemeteries used to be at these places.
