The court has not upheld the decision on her expulsion.

On December 19, the Maskouski district court satisfied the complaint of the UCP Spokesperson Hanna Krasulina about the decision on expulsion. The court also ruled to cancel the expulsion decision of the Department of Internal Affairs, writes tut.by.

On November 13, Hanna Krasulina was summoned to the Department of Internal Affairs of the Maskouski district of Minsk, where she was given a notice of expulsion from Belarus for a period of one year.

The trial

During the preliminary hearing on December 18, Chief Inspector of the Citizenship and Migration Department of the Department of Internal Affairs of the Maskouski district Philip Karatsyupa explained that Krasulina had committed several offenses during her stay in Belarus. He also noted that for one offense, committed on April 21, 2017, she had not paid the fine. The Chief Inspector also said that the experts used selective criteria to make the decision on expulsion.

“There are no common criteria, so we used the selective. Not that she was expelled for ticketless travel, but because of the earlier offenses. Different criteria are applied to each person. We also studied her affairs, what she does here, what she is engaged into,” explained the Chief Inspector. The representative of the Department of Internal Affairs spoke out against the satisfaction of the complaint filed by Hanna Krasulina.

At the beginning of the meeting, Hanna Krasulina handed over to the court a copy of the receipt of the paid fine, which, according to the representatives of the Department of Internal Affairs, she did not pay.

“I paid it on June 25, 2017, although representatives of the customer, I'm sorry, the interested party stated that the fine was not paid,” Krasulina commented.

Lawyer Natallia Matskevich petitioned to the court to demand from the Department of Internal Affairs all documents classified as “for official use”. The court requested the representatives of the Department of Internal Affairs to submit these documents, to which they refer in the resolution on expulsion, and which were actually the basis for the decision. The representatives of the Department of Internal Affairs partially submitted the documents in question to the court, but the participants of the trial cannot read them.

- These documents are known to the interested party, but not to the defendant’s party. If they are shown to all the participants in the process, this will restore the difference between the parties to the process, and I want the petition to be approved, ”said representative of the Belarusian Helsinki Committee Harry Pahaniayla in court.

Judge Volha Husakova rejected the petition.

The court also interrogated a witness - the activist’s husband Yauhen Krasulin. He said that Krasulina, having the Russian citizenship, came to live in Belarus, such a decision was made immediately after their marriage registration. Yauhen Krasulin said that in Belarus she has “all life”: family, husband, relatives, house, acquaintances, friends.

“My wife has nothing abroad, all of her life is here,” Krasulin said. “Our family’s income source is my earnings at the university department, and my wife's pension. If they expel Hanna, the consequences for our family will be very hard: my salary is enough for a month - I get about BYN 600. If she has to go abroad, there is a question of food, housing, and even if I send her all of my salary, this money is not enough for living in Russia. We also pay the loan for our apartment — BYN 89 per month. In this regard, we are helped by my mother. Hanna's parents have only daughter, their health deteriorates, my wife solely ensures adequate care of them. If she’s away, I do not know who is going to do it - I have a great shortage of free time. Hanna has a brother in Russia, but they have had no contacts for about 20 years - the last time I saw him was in 1999. It’s hard for me to imagine that Hanna could be able to live with him. Previously, we have not seen each other for several months - I was on a business trip, but even the beauty of the Maya pyramids could not make me miss my wife any less, ”said Yauhen Krasulin.

During the debates, the lawyer of Hanna Krasulina stated that she considered Krasulina’s activity and her appeal to the UN Human Rights Committee to be the reason for the expulsion. A spokeswoman for the Department of Internal Affairs said that the issue of expulsion was regulated by law.

- When making a decision, it was taken into account that Krasulina has parents here, and also adult children who can help old grandparents. Expulsion is not a punishment for any kind of offense, such a measure as expulsion is used for the purpose of upbringing, said the spokeswoman for the Department of Internal Affairs.
