REP Activist: Prosecutor's Office Changed Into Postman!
PAVEL NAZDRA

The trade union activist is outraged by investigators’ violations in the "trade union’s case".

In his appeal, the trade union activist demands from the prosecutor's office to check the actions of the investigators in the case initiated under Art. 243 Part 2 against Henadz Fiadynich and Ihar Komlik with respect to the violation of the Criminal Procedure Code of the Republic of Belarus and the exceedance of the official powers, as well as to express protest over the facts of pressure and intimidation of the REP members by the IC investigators, as well as over the facts of interference in the REP trade union’s internal affairs, praca-by.info writes.

However, the prosecutor's office did not reply ad rem, but redirected his appeal to the Investigation Committee. The Investigative Committee, in turn, did not detect any of the violations, the trade union activist complained about, in its employees’ actions:

"In your appeal you point to an unfounded interrogation as a witness in a criminal case, which is a violation of your legal rights as a citizen of the Republic of Belarus. Considering that you are a member of the Belarusian Trade Union of Radio Electronics Workers (hereinafter – REP Trade Union) and can have important information on a criminal case brought against postholders of the above-mentioned REP trade union, investigator A. Kraus had all the grounds to direct the relevant instruction on carrying out an investigative action with your participation – to interrogate you as a witness. The list of questions, specified in the relevant instruction for using in your interrogation as a witness in a criminal case, is justified and the answers to the posed questions are important for the investigation of the criminal case against H. Fiadynich and I. Komlik. Thus, investigator A. Kraus has not violated the legislation."

Pavel Nazdra has commented on the redirection of his letter:

– I do not agree with the actions of the prosecutor's office. I am going to send an appeal to the Prosecutor General asking him not to be a postman, but to fulfill his supervisory duties in accordance with Article 4 of the law "On the Prosecutor's Office." One of the prosecutor's office’s tasks is to supervise the execution of the law in the course of pre-trial proceedings, preliminary investigation and inquiry. In accordance with Art. 6 of the law "On the Prosecutor's Office", the prosecutor accepts the measures provided by this law and other legislative acts to suppress violations of the law, whoever the violator might be, bringing to justice those violating the law, restoring violated rights and legitimate interests of citizens and organizations.
