Leader Of Babruisk REP Trade Union Struggling With Forgers From Police
Halina Smirnova

All the legal demands of Halina Smirnova's lawyer were ignored by the police.

Halina Smirnova, the leader of the Babruisk REP trade union, sent a complaint to the Babruisk District Court against the officer of the traffic police Captain Kozyrau who fined her over alleged "crossing the street in the wrong place", the website praca-by.info informs.

On the night of March 24, Halina Smirnova was subjected to the so-called preventive detention: police officers met her at the entrance, put her in a car, interrogated and searched in the police department, and then sent to the remand prison for three days. The law-enforcers at the same time committed a huge number of procedural violations; so, for example, it took them very long to choose a single version for what kind of violation the activist spent three days in the detention center. As a result, Halina Smirnova was penalized for crossing the street in the wrong place - despite the fact that at the time of the alleged violation she was traveling in a taxi home (shortly before the detention). Halina Smirnova filed a complaint against this decision.

In the document, the activist consistently outlines all violations committed by the police:

"In the Internal Affairs Directorate, police senior lieutenant Yauhen Kaliachka, without explaining to me my rights, fabricated an administrative offense protocol against me allegedly for crossing the Maskouskaya Street in the area of house #31 in an unidentified place. Officer Kaliachka was fully aware that I was sober and sane, legally literate in such matters, and therefore could not commit and did not commit the offense with which I was charged.

The second protocol against me, also without explaining my rights to me, was fabricated for disobeying to the allegedly legitimate demands of police officers, although the policeman who made the report knew that I did not disobey their demands, due to my legal literacy and experience in political and trade union affairs. And that's why, even if we proceed from a false version of the police, I would never have added a very probable arrest for up to 15 days to the fine of up to 3 base fees from the traffic police.

All my legitimate demands to give me the opportunity to exercise the right to defense with the help of a lawyer from the beginning of the administrative process have been ignored. "
