Homel Unemployed Wins Trial Over Prosecutor

The independent trade union of the radio-electronic industry workers (REP) helped the resident of the city.

On October 14, Aksana Kastiukevich, a judge of the Savetski district court of Homel, refused to the city prosecutor in a lawsuit to recover from unemployed Kanstantsin Aksionau BYN 3,342 (about $ 1635), spent by the state on his training as a trolley bus driver, Homel Spring reports.

The guy joined the independent REP trade union, and as it turned out, it was the right decision.

His interests in court were represented by the legal labor inspector of the REP trade union Leanid Sudalenka, who recalled how a young man, following the instruction of the city employment department, undertook the courses to be trained as a trolley bus driver, but was not allowed to work because of his health condition, despite the fact that he had previously been found fit. Such a verdict was handed down to him in the same specialized clinic # 7.

“The court hearings of the case lasted for two months, the court thoroughly questioned all the doctors related to the medical examination. It turned out that two doctors, like lawyers, have three opinions. One sets the diagnosis: the man is healthy, he can be sent to the outer space, the other objects, like, he is unfit for work. We initially stated that Kanstantsin Aksionau should not pay for the mistakes of the doctors, and today we defended this position in court,” the trade union lawyer shared the outcome of the case.

The decision of the first instance court has not entered into legal force and can be appealed by the prosecutor's office to the Homel regional court within 15 days.
