REP Trade Union Lawyer Sues In Favor Of Workers Over $120 K Last Year

People come to Leanid Sudalenka for legal aid all the time.

An NPP foreman, loaders, warehouse keepers, poultry factory workers, a waiter, a stick, a moulder, an electric welder, the dead girl’s parents, and a pensioner – all these people, and not only them, received legal help from the trade union lawyer Leanid Sudalenka in 2018, Homel Spring writes.

The total amount of money sued in favor of the people of labor is BYN 266, 948, or $ 127, 118.

People come to the Homel branch of the REP Trade Union all the time to obtain legal aid. The people are put before the choice: to go to expensive lawyers or to join the independent trade union, pay the membership fees and receive free legal help in return.

Journalists have compiled a set of five cases, which Leanid Sudalenka handled in courts in 2018, and managed to defend the interests of his clients: either to recover money from employers, or achieve the decrease of payments which they had been incriminated with by the employer.

1. The case of the Homel liqueur and spirits/vodka plant “Radamir” - the court refused to demand BYN 84K over an employer’s lawsuit from the workers.

2. The case of the Homel Fat Factory - the court refused to demand BYN 77,760 over an employer’s lawsuit from the workers.

3. The case of the deceased schoolgirl Vika Papchenia (Maladechna) – the court recovered BYN 50 K in favor of the parents of the deceased child as compensation of moral damage.

4. The case of Rechytsa oil suppliers “Nefteburservice” - the court refused to demand BYN 17,600 over an employer’s lawsuit from the workers.

5. The fifth position is occupied by a series of lesser cases, which make the daily routine of the trade union lawyer.

а) The case of the Rechytsa sawmill worker Henadz Litvinau – the court established the fact of labor relations, obliged the employer to recognize the fact of an industrial accident and pay the worker the 5-month sick leave, and also ordered to collect compensation of moral damage for the total amount of BYN 13,300.

b) The case of the Rechytsa water services company worker Uladzimir Parkhuta – the court surcharged the unpaid pension for 27 months in the total amount of BYN 8.600 from the employer.

с) The case of the poultry factory “Khalch” JSC workers Larysa Sarokina and Alena Katliarova – the court recovered three average monthly salaries in connection with dismissal over the workers’ demand in the amount of BYN 8,200.

d) The case of Homel waiter Artsiom Kasilau – the court collected in his favor an average salary for the 19 months of forced idleness in the amount of BYN 4,818.

е) The case of the Rechytsa orphan Viachaslau Harlenka – the grammar school demanded, and the court refused to order compensation of the expenses for education in the amount of BYN 4,188.

f) The case of the JSC “Homelpromstroy” foreman Siarhei Rahoutsau, who worked at the Astravets NPP – the court recovered from the employer the illegally deducted monetary sum in the amount of BYN 3,300.
