Belarusian Policeman Allowed To Stop Cars “For Checking Documents”

The authorities want to fix the right of the traffic police to stop vehicles “for checking the documents” in the driving regulations.

The corresponding Lukashenka’s draft decree has been proposed for public consideration, which will take place from 2 to 15 May.

A lot of videos, which show inspectors’ conflicts with drivers, most often begin with the phrase: “The reason for the stop.” The traffic police are confident that they have the right to stop vehicles to check the driver's documents, the latter do not agree with this, in turn, referring to the documents where there is no such reason. So now want to add the words “including the examination of the documents referred to in paragraphs 12-15 of the Regulations” to the subparagraph 9.1 of the driving regulations (The driver is obliged to stop upon the demand of the traffic police officer in uniform...), tut.by writes.

– In accordance with subparagraph 9.1 of the driving regulations the driver must stop on the traffic policeman’s demand. The grounds for such legislation requirements are not specifically defined. On the basis of the nature of monitoring the road users, it must be assumed that such a stop can be carried out to check the driver’s physical condition, his right to drive motor vehicles, other documents, the fulfillment of regulations requirements and other legislation in the field of road safety. This possibility is confirmed by the provisions of paragraph 12 of the driving regulations, as well as other legislative acts, –the need for adopting the decree is justified. – At the same time, some individuals deliberately provoke a conflict with the traffic police, arguing that there is no such reason to stop the vehicle, as the need to verify the documents. In order to concretize the provisions of the law in this part, it has been proposed to amend the instructions.
