Will Supreme Court review Zhaleznichenka’s case?

Ala Zhaleznichnka, mother of Homel pro-democracy activist Zmitser Zhaleznichenka, who had been expelled from the university twice and who is serving in the army now, has addressed the chairman of the Supreme Court Valyantsin Sukala.

Ala Zhaleznichenka asks to check legality of decree of the court in the civil case of her son and to make a notice of protest against them in exercise of supervisory functions. Zmitser Zhaleznichenka, deputy head of the region organisation “BPF Youth” was expelled from F. Skaryna Homel State University two times. He showed good academic results and didn’t miss classes without good excuse. First he was expelled in September 2007, but by a court ruling in the end of January 2008 we was reinstated. But after four days he was expelled again and drafted for army. He refused to take the oath protesting against that decision. The district and regional courts confirmed the decision of the rector to expel him. That was the ground for addressing the Supreme Court, the BelaPAn writes.

As told by a human rights activist Leanid Sudalenka, Z. Zhaleznichenka and his mother do not agree with the court decisions, as when the violation of the Administrative Code by Zmitser took place, and which became the reason for his another expelling from the court, he wasn’t a student. Besides, it was illegal to expel him in a period when he was on home leave because of an illness. The young man’s mother also notes that to expel a student a permission of a trade union committee is needed, and not of a trade union presidium, as it was in the case of Z.Zhaleznichenka.
