Constitutional Court does not agree to view Lyubou Kavalyova's appeal

The answer from the Constitutional Court says only specially authorized bodies can appeal to the court.

We remind that the mother of sentenced to death Uladzislau Kavalyou asked to declare a provision of the Criminal Procedure Code unconstitutional. The Code does not provide for suspending execution after filing and registering an appeal to the UN Human Rights Committee.

Lawyer Raman Kislyak does not agree with the answer from the Constitutional Court, Viasna human rights centre reports. According to Kislyak, Kavalyova appealed to court asking to give not a judgement, but a decision. Delivering court decisions meets the existing practice. On the base of appeals from individuals, the Constitutional Court takes a decision, where it estimates if certain spheres comply with the Constitution and international legislative acts.
