Court recognized forcible draft of Franak Vyachorka “legal”

Minsk city court has upheld the ruling of the court of Savetski district which recognized draft of Franak Vyachorka legal.
The case of Franak Vyachorka was tried by judge Natallya Zhupikava. In September 2003 by her decision she liquidated human rights organisation “Legal assistance to the population”. In October 2003 Natallya Zhupikava prevented parents of students of Yakub Kolas Belarusian Humanities Lyceum from lodging a protest against liquidation of the institution. She denied demands of the parents to conduct the trial in Belarusian.
In November 2003 she increased 5 times the sum of the fine imposed on the “Narodnaya Volya” newspaper by the court of lower instance. In 2006 she dismissed the suit of the United Civil Party activist S. Alfer to sue customs office that had confiscated his property.
On February 26 at the session of the panel of Minsk city court father of the forcibly drafted young leader, the deputy chairman of the Belarusian People’s Front Vintsuk Vyachorka and their lawyer said that the court and the military enlistment office of Savetski district impudently violated the Law on military service and military service duties, and the Civil Procedure Code.
The court was obliged to invite Franak Vyachorka to the session of the court, but it hadn’t been done. No one had a right to take Franak to the army before entry of decision into legal force.
It should be noted that there are two different versions of the draft commission session records are attached to the file of Vyachorka’s draft. There are no figures of blood pressure in the document on F. Vyachrka’s “check-up” in the military hospital, and the eye doctor studied him “in his absence”.
As we have informed, on January 16 Franak Vyachorka was forcibly detained by people in mufti in the ward of military hospital where the young man was placed for check-up. Franak was taken to the military enlistment office in handcuffs. And there he was told he is to be taken to the military unit. In the military unit officers told they had medical decision that Vyachorka is able-bodied. Earlier he had a determent due to eye surgery and some chronic diseases. In the military enlistment office Franak stated that he would lodge complain against actions of military men and doctors who had been receiving orders of people in mufti.
After that Franak Vyachorka was released. On January 19 Franak Vyachorka appealed against the actions of the military men and doctors at the draft campaign. The court informed the military enlistment office that draft is suspended before the appeal is considered in the court. But on January 28 people in mufti seized him in the street. He was beaten up by him in a car, and later in the military office. Then handcuffed he was taken to the military unit in Baranavichy. Franak Vyachorka’s parents were told that a trial had been held in absentia, and the court admitted Franak Vyachorka fit for military service despite problems with his health.
