Independent Trade Union Helped Worker To Return Almost $ 1500

The Minsk enterprise Guarantor of Quality will pay the dismissed concrete worker debts on wages and compensation.

The court of Tsentralny District of Minsk considered the claim of the REP trade union member Pavel SpiatsyjanYury Beliakou, praca-by.info informs.

In the statement of the claim, Pavel asked the court to oblige the defendant to dismiss him under Article 41 of the Labor Code, to surcharge from the defendant the wages, final payment and the three-fold average salary upon dismissal.

In August of last year, the young man got a job as a carpenter-concrete worker with a salary of 900 rubles a month and signed a contract. But already in February this year, he wrote a letter of resignation under Article 41 of the Labor Code – at the request of the employee: in October, November, December of 2016, the employer delayed paying him wages for up to 1 month.

Also, Pavel Spiatsyjan’s salary and vacation payment for January 2017 were delayed.

The Minsk Department of State Labor Inspectorate confirmed all the facts of violation of labor legislation indicated by Pavel.

On April 6, 2017, Judge Dluzhneuski ordered to terminate the contract between the defendant and Spiatsyjan at the request of the employee.

The LLC Guarantor of Quality has to pay the final payment of 134.65 rubles and 2,748.69 rubles of the three-fold compensation of the average earnings under the contract. If totaled up – 2883.69 rubles.

The lawyer representing the interests of the defendant was stiffly. The main argument on which she asked the court to dismiss the claim, sounded as follows:

– And if everyone does this, then where will the employer get the money to pay off to everyone? I think this is wrong!
