The Belarusian woman was sentenced to six years in prison for abuse of power and damage to the enterprise, but after the colony the sentence was revised, the fine was reduced, and the property was returned.
A lawyer, head of the legal counseling office of Novogrudok district of Hrodna Regional Bar Association Viktoria Vavulina told about it.
The verdict against K. (the woman's name is not given) was passed in 2016. She was charged under Article 426 (Exceeding power and official authority, causing grave consequences in the form of causing damage to the organization on a particularly large scale). She was sentenced to 6 years in prison. She was also charged about 250 thousand rubles of damage caused to the enterprise.
While serving her sentence, and after it, the woman continued to file supervisory appeals in her case, despite repeated refusals.
"In the supervisory instance of the Supreme Court, the position was chosen that the materials of the criminal case lacked sufficient reliable and admissible evidence confirming the amount of damage caused to the enterprise. And the conclusions of the financial and economic expertise were of a conditional nature, were assumptions, and, accordingly, could not confirm the circumstances to be established in the case. The initial data contained in the case materials did not meet the requirements for evidence", - the lawyer lists the errors.
In addition, in the period when the woman allegedly committed the crime, the prosecution included her maternity leave for three years. As a result, the prosecutor's office upheld the supervisory protest and the case was sent for a new appellate review.
"The new appellate review took into account the circumstances set forth by the defense counsel and the defendant when giving explanations. As a result, the amount of damage was reduced from 250 thousand to 6 thousand rubles, the accused was released from criminal liability (usually this means that a person is removed from the database of those convicted under a criminal article. - Editor's note), the confiscation of her property was canceled," the lawyer writes.
