The REP trade union will not allow paying off the Homel fat plant’s shortage at the expense of the workers.

On April 23, the Navabelitski district court of Homel will reconsider the case of a large (over 52 thousand rubles) shortage at the Homel fat plant, Homel Spring informs.

We remind that on March 22, the Judicial Board for Civil Cases of the Homel Regional Court discharged the previous court order and sent the case for further consideration. Taking into account the large number of defendants (34 employees), the court hearings will be held at the assembly hall of the enterprise on April 23, 24 and 25.

The interests of four defendants are represented in court by Leanid Sudalenka, the REP trade union labour rights inspector.

– I stated it during the previous trial, and now I declare that the court is obliged to apply in the case the norm of the Collective agreement on limited liability. In other words, the enterprise has established a limited liability for its employees in the amount of 20% of their average earnings, and the court refused to apply it at the first hearing. We have canceled such an absurd decision of the judge by lodging an appeal, we will see how another judge will react to the norms of the Collective agreement," – the trade union lawyer says.

We will not ask, we will demand indemnity against liability of workers who have joined our REP trade union, the labour rights inspector adds.

The case of the Homel fat plant has been considered by the court since February 5, 2017.

The prosecutor of Homel lodged a claim for the benefit of the enterprise in the amount of about 35 thousand dollars after a state control inspection, which was considered the utilization at the enterprise as damage to the state property. The utilization was held because the shelf life of goods bought for making soap and mayonnaise had been over, for this reason they were not put into production, but disposed of.
