Who Can Get Access To The Tax Secrets Of Belarusians?

A new document was approved.
Belarus has approved the Regulation on the order of storage of information constituting tax secrets, access to them and their disclosure. The document is published on the National Legal Portal.
According to the document, information that constitutes tax secrecy can be stored on paper and in electronic form. In this case, information on paper can be stored in safes or boxes that exclude unauthorized access to them. In electronic form information must be processed and stored taking into account the requirements of legislation on information, informatization and information protection, as well as legislation in the field of archiving.
The list of information that constitutes a tax secret is prescribed in the Tax Code. These are, for example, the name of the payer, his registration number, the number of taxes paid, etc.
According to the new decree, this information may be obtained by:
- experts and specialists involved in audits;
- courts when considering cases;
- law enforcement agencies, as well as their officials in the performance of their duties;
- the Ministry of Labor, Ministry of Economy, Federal Tax Service of the Russian Federation, etc.;
- the Ministry of Finance, the Ministry of Finance, the Ministry of Labor, the Ministry of Economy, the Federal Tax Service, etc. etc.;
- banks, non-bank credit and financial organizations, etc. for organization of works on formation and functioning of the unified settlement information space, etc.
Above all, other persons not specified in the provision may get access to this information upon request of competent authorities. In this case, for access to tax secrecy they need to confirm the right to obtain such information, as well as to justify the motive.
At the same time, persons who have access to tax secrecy may not disclose this information.
