“Parliament” turns down Lyubou Kavalyova’s request

The mother of the convict asked the “parliament” to address the Constitutional Court concerning discrepancies about death penalty in the Criminal Code of Belarus.

Belarusian “MPs” turned down this request of Lyubou Kavalyova, the mother of Uladzislau Kavalyou, who had been sentenced to capital punishment, Radio Racyja informs.

In her letter Lyubou Kavalyova urged the “parliament” to address the Constitutional Court and ask to consider lack of conformity between the Penal Code of Belarus and the Constitution of Belarus and the Facultative protocol to the International Covenant on Civil and Political Rights.

“There are no provisions in the Penal Code which envisage suspension of execution of the sentence in the form of death penalty in connection with my addressing international organizations. The sentence could be executed any moment. Answers from these organizations have been received: according to them, there are no grounds for addressing the Constitutional Court,” Kavalyova said.

In the answers the right to appeal from the judgement in the exercise of supervisory powers in the Supreme Court and the pardon from Lukashenka are reminded. As Lyubou Kavalyova believes, possibilities of defense under the Belarusian law are stressed.

“The question of pardon has not been considered at Lukashenka’s administration yet. The last word belongs to him,” Lyubou Kavalyova said.

We remind that Uladzislau Kavalyou and Dzmitry Kanavalau were sentenced to death penalty for terrorism (Kavalyou for implication in terrorism). According to the story of investigators, he knew about preparation for the terrorist attacks, but had not informed law-enforcing agencies. During the trial Kavalyou pleaded not guilty.
