The EU Court Of Justice Refused To Lift Sanctions Against MAZ And BELAZ

The companies tried to challenge Brussels' decisions.
The EU Court of Justice dismissed the claims filed by the management companies of the “BELAVTOMAZ” and “BELAZ-Holding” holding companies, which had sought to overturn the decisions to maintain sanctions against them. The rulings in both cases were handed down on September 23. This was reported by the Telegram channel The Sanctions Law.
The cases in question involve the Minsk Automobile Plant (MAZ) and BELAZ.
The companies contested the effective equating of state ownership with support for Alexander Lukashenko’s regime. However, the court deemed the grounds previously presented by the Council of the EU to be sufficient. The assessment took into account several factors: the state-owned nature of the enterprises, their importance to the Belarusian economy, and the fact that they are a source of revenue for the state.
In considering the MAZ case, the court took into account the company’s significant growth in production and sales, as well as a public statement by Alexander Lukashenko, who called the enterprise one of the key players in Belarusian industry.
Regarding BELAZ, the court took into account data on the enterprise’s profitability and new equipment deliveries.
The companies also pointed to the impact of the sanctions on their operations and employees. MAZ, in particular, argued that the restrictions contribute to a further strengthening of Belarus’s economic ties with Russia.
The court noted that the potential negative consequences of the sanctions—including those affecting the companies’ employees—do not in and of themselves render the restrictive measures unlawful. The argument that the sanctions strengthen economic ties between Belarus and Russia also failed to convince the court.
