Poland provided clarification on the freezing of time limits for international protection cases.

Poland has frozen the deadlines for international protection cases until March 4, 2026. The Office for Foreigners explained what this means and why such measures were introduced, noted Most.

The office noted that the decision does not mean the suspension of proceedings on cases - they will be considered and new applications will be accepted. But the state body is not obliged to meet the deadlines established by law (it is 6 months from the date of filing an application, and in complicated cases or in case of a large influx of applications - 15 months).

In addition, the Office for Foreigners is not obliged to notify applicants that the case will not be considered within the established time limit. And no complaint can be filed against the authority's delay or inaction. From 2022, the same practice applies to residence permit cases.

"During this period (until March 4, 2026 - Note), the provisions on inaction of the authority, delay in proceedings and the obligation of the authority conducting the proceedings to notify the party or party to the proceedings of the failure to examine the case within the time limit shall not apply. In addition, the body conducting the proceedings shall not be fined or awarded monetary sums in favor of complainants for failure to make decisions within the time limits established by law", - says the clarification of the Department.

The adoption of such a norm was associated with the next increase in the number of applications, primarily from Ukrainians. And its purpose is to adapt administrative procedures to the "current emergency migration situation".

"Proceedings [on cases] will continue to be conducted as efficiently as possible," the Office for Foreigners assured.
