Will it be necessary to remodel homes that have already been built starting December 1?
Starting December 1, 2026, changes to building codes will take effect in Belarus that will affect owners of private homes and land parcels. It will no longer be sufficient to reach an agreement with a neighbor to reduce the distance between a structure and the property line. Even a notarized agreement will no longer allow for deviations from the established requirements. Experts at the agency “Avangard Real Estate” explained whether an existing house needs to be rebuilt to comply with the new rules.
What distances must be observed during construction?
According to a decree from the Ministry of Construction and Architecture, updated building codes regulating the placement of structures on adjacent plots of land will take effect on December 1 of this year. According to the updated building codes, the requirements are as follows:
a residential house—at least 3 meters from the boundary of the neighboring lot;
an outbuilding—at least 2 meters from the boundary of the neighboring lot.
Previously, owners could agree with their neighbors to reduce these distances. This required obtaining a notarized consent form from the adjacent landowner.
As of December 1, 2026, this option will no longer be available. Compliance with the established distances will become mandatory regardless of any agreements between the owners of neighboring lots.
Where should you measure the distance to the property line from?
When planning construction, it is important to consider not only the size of the lot and the location of the fence, but also the legally established property boundaries.
The distance is measured from the wall or foundation (basement) of the structure to the legal boundary of the land plot, not to the neighbor’s fence.
Why is this important? The fence may be offset from the actual property line. Therefore, a visually sufficient distance to the fence does not always mean that building codes have been followed.
To avoid mistakes as early as the design phase, it is recommended to clarify the plot boundaries in advance and commission the necessary surveying and cadastral work.
This is especially important for irregularly shaped lots, properties with existing fences, and structures planned for construction in close proximity to neighboring land.
Is it necessary to rebuild an existing house?
The new requirements do not mean that all owners of houses located closer to the lot boundary than permitted by the regulations must immediately relocate their structures or alter their dimensions.
According to the explanations provided, the updated regulations apply to new construction. Existing structures do not need to be brought into compliance with the new distance requirements.
However, there is an important caveat regarding renovations.
If a house or outbuilding is already located closer to the boundary of a neighboring lot, the building’s dimensions cannot be increased toward the neighboring property during renovation. In other words, expanding a structure in a way that brings it closer to the property line is not permitted.
